Terms of Use and Liability Waiver
This E-course and its videos, documents and other associated content (hereinafter inclusively referred to as “E-course”) has been produced by Compassio Medical, LLC.
When you purchase our E-course, you agree to the terms set forth below.
All sales are final for E-courses, and no refunds are issued for online courses once a sale is completed. The supplies and props used for any exercises instructed are not included in the purchase price of the E-course.
The information in our E-course is for informational purposes, and is only intended to provide you a helpful introduction to means and methods that may assist you in making medical diagnoses, and in otherwise assessing your patients. The information in this E-course will not apply to all conditions, disorders, and health-related issues you will encounter in your practice. We do not intend, nor provide, any representations, guarantees, or warranties regarding the appropriateness of the means and methods discussed in this E-course for use relative to any specific patient. Each patient presenting to you will bring his or her own unique medical history and risks, which will require your own professional assessment of the appropriate means and methods to use in connection with the care to be provided. You are encouraged to familiarize yourself with the risks underlying each patient encounter, and seek consultation if in doubt of the appropriateness of applying what is learned in this E-course to your patient.
The content of this E-course is not intended to be a substitute or replacement for your own professional medical advice, diagnosis and treatment, and your acceptance below confirms that you acknowledge and understand that you shall not make medical decisions based exclusively on the content presented within the E-course. Furthermore, you acknowledge and understand that participation in this E-course does not create a physician collaboration relationship with any of the creators or presenters in the program.
This E-course may provide links to third party web sites or information. We do not guarantee or endorse the content on any third-party websites. We are not responsible for the content of linked third-party sites, sites framed within the site, third-party sites provided as search results, or third-party advertisements, and do not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites.
This Agreement shall be governed and construed in accordance with Louisiana law, without giving effect to the principles of conflict of laws. Any cause of action by you with respect to the E-course or the terms of this Agreement shall be brought exclusively in a court of proper jurisdiction in the State of Louisiana.
Hold Harmless, Indemnity, and Jurisdiction
HOLD HARMLESS In no event shall Compassio Medical, LLC and/or Dr. Jeffrey Lacour, any person providing educational information in the E-course (each a “Presenter”), or any other third parties participating or mentioned in the E-course, be liable for any claims or damages (including, without limitation, direct, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the content presented, or my participation, in the E-course, whether based on warranty, contract, tort, or any other legal theory, and whether or not Compassio Medical, LLC and/or Dr. Jeffrey Lacour is advised of the possibility of such damages.
INDEMNITY You agree to defend and indemnify Dr. Jeffrey Lacour and Compassio Medical, LLC, its officers, trustees, employees, agents, content providers, Presenters, and other third parties, against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your participation in this E-course, including but not limited to claims arising in connection with your care and treatment of patients.
JURISDICTION These Terms and Conditions are governed by the laws of the State of Louisiana, without respect to its conflict of laws principles. You expressly agree that exclusive jurisdiction for any dispute in any way relating to your participation in this E-course will be in Louisiana state and federal courts, and you further agree and expressly consent to the exercise of personal jurisdiction in the state and federal courts of Louisiana in connection with any such dispute falling under the terms of this Agreement.
